Website Terms of Use

These terms set out the conditions on which you may use pulscale.com (the "Website"). Please read them before using the Website. If you do not agree, please stop using it.
The Website is operated by Pulscale Ltd, a company registered in England and Wales under company number 17352743 ("Pulscale", "we", "us" or "our"). Our registered office address is published under Company details in our Processing Register.
1. Scope
These terms apply to the Website only. Use of the Pulscale platform and related services is governed by the agreement between Pulscale and the customer, not by these terms.
These terms do not amend or replace any Customer Agreement, Data Processing Schedule or other separate agreement between you and Pulscale. They do not qualify commitments in the Processing Register where those commitments apply under your customer agreement.
2. Information on the Website
The Website provides general information about Pulscale and its products. We aim to keep it accurate and up to date.
Descriptions of planned features and product direction indicate our current intentions and may change. They are not commitments to deliver particular functionality or release dates. Any commitment to provide platform functionality will be set out in the applicable Customer Agreement or Order Form.

3. Acceptable use
You may use the Website for lawful purposes only. You must not:
- use the Website in any way that breaches applicable law or regulation, or that is fraudulent or harmful;
- attempt to gain unauthorised access to the Website, the server on which it is stored, or any system or database connected to it;
- introduce viruses, malware or other harmful material, or attack the Website through a denial-of-service attack or similar means;
- copy or extract content from the Website in bulk by automated means without our permission (ordinary search-engine indexing and assistive technologies are not affected);
- impersonate any person or misrepresent your identity or affiliation when contacting us or joining our waitlist.
4. Intellectual property
The Website and its content, including text, graphics, product images, logos and the Pulscale name, are owned by Pulscale or its licensors. You may view the Website, print or download pages for your own reference, and share them within your organisation for internal business purposes. Other uses require our prior written permission, except as permitted by law. Nothing in these terms grants you any licence to use the Pulscale name or logos.
5. The waitlist and information you send us
The Pulscale platform is not yet generally available. Joining the waitlist does not create a subscription or guarantee an invitation, access date or particular product functionality.
If you join our waitlist or contact us, we use your information as described in our Privacy Policy. Please do not send confidential information or other people's personal data through the Website.
You do not have to provide suggestions or feedback. If you voluntarily provide non-confidential suggestions about our products, we may use those suggestions to improve our products without paying you. This does not affect your data protection rights or any separate confidentiality agreement with us.
6. Links to other websites
The Website may contain links to websites operated by others. These links are provided for convenience only and do not mean that we endorse those websites. We are not responsible for their content or availability. Other names and logos on the Website belong to their respective owners.
7. Availability
The Website is provided free of charge. We may change, suspend or withdraw all or any part of it at any time. If you breach these terms, we may suspend or block your access.
We do not guarantee uninterrupted or error-free access to the Website, or that it will be free from viruses or other harmful material. These statements do not limit our legal obligations or any express commitment in a separate agreement with you.
8. Our liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing in these terms restricts your statutory rights, including rights under applicable consumer and data protection law.
If you use the Website for business purposes, subject to the paragraph above, we exclude liability for loss of profits, revenue, business opportunities, goodwill or anticipated savings, and for indirect or consequential loss arising from your use of the Website.
These exclusions do not apply to consumers.
9. Privacy
Our Privacy Policy explains how Pulscale Ltd uses personal data about website visitors and waitlist contacts. Our Processing Register describes processing arrangements for customer data handled in providing the platform and related customer services; it is not a list of website or waitlist providers.
10. Changes to these terms
We may update these terms from time to time by publishing a new version on this page. Changes apply to use of the Website after the updated terms are published and do not alter rights or liabilities arising from earlier use.
11. General
Subject to clause 1, these terms govern your use of the Website only. If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply. If we do not enforce any of our rights straight away, we can still do so later; a waiver is effective only if made in writing.
A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of them. This does not affect any right or remedy available independently of that Act.
12. Governing law and jurisdiction
These terms and any related non-contractual disputes are governed by the law of England and Wales. If you use the Website for business purposes, the courts of England and Wales have exclusive jurisdiction.
If you are a consumer, this choice of law does not deprive you of mandatory protections available under applicable law. Nothing in these terms restricts any right you have under applicable law to bring or defend proceedings in the courts of your home jurisdiction.
